    Here's the percentages of the top 10 populations of the world by nationality. How many of them are more than 7% ?

    China 20.0 %
    India 17.2 %
    United States 4.6 %
    Indonesia 3.4 %
    Brazil 2.8 %
    Pakistan 2.6 %
    Nigeria 2.5 %
    Russia 2.2 %
    Bangladesh 2.1 %
    Japan 2.0 %

    Based on this one can conclude that the 7% nationality rule is a veiled effort to limit Indian and Chinese immigrants specifically. Does this not amount to discrimination by nationality ? In addition we as legal immigrants are taxed without any representation. Taxation without representation was the reason the US was created in the first place.

    US history is full of examples where discrimination existed in one form or another and these discriminations were sucessfully challenged. A few examples are women's voting rights, minority voting rights and gerrymandering. These are good examples to study where the affected people had no legal voice to begin with.

    The civil rights movement is a recent example. There were existing laws that limited people from voting based on their literacy levels in the southern states. The literacy requirement for voting was really a thinly veiled attempt to limit voting rights of african americans for as long as possible. The civil rights movement was about changing these artificial laws to give voting rights to people who legally had no voice.

    You don't need to be a lawyer to speak up for your hardships as a law abiding resident. This country has tremendous protections for people living here which is what makes it great. We as an immigrant community need to build our awareness of US history and government if we expect things to change.

    Let me slice & dice your thought!

    this is totally lame idea!Why, do you have any brighter idea than this? Until you have one at least this is something to act upon! Though, if you have an idea please post, majority of people on this forum are good listeners and executioners unlike you maybe.
    immigration policy is a social and an economic issue..not just economics..At least we are putting something on the table that can take care of one issue in your opinion i.e. the economic issue, pls let the social issue aside at least the way you are putting it, it sounds more like a racist issue!!!
    They dont want too many ppl from one country ..that is the reason for 7% quota...why cant you digest that fact...How many times have other members mentioned to folks like you that the people you are talking about are already in this country, unlike you I do not see why would there be any concern around having too many ppl from one country? It seems like only you seem to be scared of a different breed around you!
    we can fight injustice if we feel we are being treated in an unfair manner..is this justice to restrict EB categories by country limits and not having such limit for H1Bs or L1s? Why not have same policies across the board if it's right? You might think this is justice because of your racial thoughts!
    but this carrot-and stick approach will back fire...I can partially agree to this...we have to make sure this approach does not back fire!

    i know many who have bought homes even when they were on H1...In which case you would also know many who haven't bought homes because they are unsure about their greencards! (ps - I am house owner so this one don't really matter to me but I am all up for it.)

    I did read that part and hence my question was if I am in the fourth/fifth year of my CA PR when I decide to go to CA, will I be allowed at least in the country.

    Another question was if I am in my 4th/5th year and know that it might take me another year before I go to CA, can I apply for CA PR again, even when I already have my CA PR OR if I apply for my CA PR immediately after my current CA PR expires, would I get it again (assuming I have the necessary points)

    Permanent residents

    Persons who have been admitted to Canada as permanent residents have the right to come to the country and remain here, provided they have not lost that status or it has not been established that they have engaged in activities, such as criminal acts, that would otherwise subject them to removal.

    Conditions may be imposed for a certain period on some permanent residents, such as entrepreneurs. A permanent resident must live in Canada for at least 730 days (two years) within a five-year period. In some situations, time spent outside Canada may count. All permanent residents must comply with this residency requirement or risk losing their status.


    According to the website, you will lose your status if you go to Canada in the 5th year because you won't be able to attain the requirement of living in Canada for at least 730 days (two years) within a five-year period. Actually, after you pass your 3rd year, you will be in risk for the permanent status.

    Yes BP, in that case Britain too will be oversubscribed just like IN,CH,MXa and PH.
    7% ceiling applies to all the countries not just the ones that happen to be oversubscribed now.

    O.K. Forget for a moment about IN,China,MX and Philipines. Let me understand the "Quota" witihin "ROW"

    Example: Britain, Pakistan.

    Let's say next year tons of nationals of Britain Choose to apply under EB.
    Let's say total is more than 7% of Total 1,40,000 limit.

    Is that allowed?

    Same question for Pakistan...

    I know. I work for a prestigious law firm and I know how hard it is to become a lawyer.




    There was a thread some time back about people considering going to law school and becoming their own lawyers. What I took out of it was that its not that easy. Besides going to school, you have to pass some tough state exams. I am quite happy with my lawyer. I paid some dough but its much cheaper than going to law school, and saves me time and headache.

    Going to law school is not for everyone, definitely not for me (fat books scares me :eek:). I like the suggestion by garybanz about getting a qualified opinion. Just so that we know.

    BTW its taking anywhere between 52-65 weeks to get Canadian PR now. They process ur initial application after 52 weeks only and any time taken on top of it is extra..

    Canada Immgration back is also visa post quota based unlike birth country
    (not citizenship) based.
    Therefore as an Indian if you apply in India then backlog is massive (5 yrs).
    However just like in US system exceptions are there for Indians born outside India, Indians in US on H1B visa can apply in US where backlog is lesser.

    In the Canadian system you can apply in your county of citizenship or country where you are admitted for more than 1 year (eg H1B , L1 ,F1 ,J1 )

    Sonia has this immense lust for money and power.Though I'm least interested in her antics during Indira Gandhi regime and Rajiv Gandhi regime I'll add few lines.

    Apparently precious antiques were moved from chennai to Italy.Near Orbassano where her mother lives there are two antique shops called Ethnica in Revlota and Ganpathi.These are blue collar areas.Her birth certificate says she was born in Turin but she told parliament that she was born in Orbassano.

    Media says that she is from middle class family.But apparently there were few journalists who went to her town in Italy and apparently she comes from very poor family in Italy.

    Middle class or poor family a person working as an aupair girl went to same restaurant as to the one to which elite folks like grandson and son of a coutnry's PM would go is interesting.Kind of unimaginable even in these days of reduced economic disparities as rich folks have their own hanging out spots.
    There was something about Opus Dei,KGB thing mentioned in connection with Sonia in some articles.

    Application for 1 person:

    1. Lawyers fees = $500...............paid by me....not sure if any paid by my company
    2. AP+EAD = $350(170+180).....paid by me
    3. I-485 = $395..........paid by company
    6. Fedex = $60...........paid by me
    7. Medical = $170(no shots needed except TB test)....paid by me


    So all i all I paid $1080 and my company paid atleast $395(and maybe some legal fees too)

    And belive me guys I am at the lower threshold since I did not need any shots and did not loose any work days........

    So minimum loss to the company and individual(1 pesron only)is atleast 1475 bucks. So before making any conclusions keep this as the lowest threshold.However since we might get the $395+$350 back so the net loss to the individual at minimum will be $730/person and maybe $500/person to the company so making it atleast $1230/for 1 person.

    Assuming that appx. 45000 people were planning to apply....I guess we are at minimum $55350000 loss......and this is a very modest estimate......as I mentioned at the lower threshold.

    Three facts, followed by one interpretation.

    First: several members (incl self) have checked with their own lawyers and these lawyers tend to agree with the common interpretation of validity for entire month. And at least some of these are lawyers with many years of practice.

    Second: Fragomen, the largest immigration law firm, on its website mentions the mid-month possibility; so while there is no government source, the whole topic cannot be dismissed as an unfounded rumor.

    Third: Macaca keeps cutting and pasting from the ombudsman's report in many different colors.

    My interpretation:
    The mid-month concept seems to be a matter of opinion. Multicolor posts notwithstanding, there's nothing official on this matter so far. (I emailed the state department seeking an answer; not surprisingly, I haven't heard back. If anyone else can get something from the horse's mouth, then post it here. If you can get stuff only from the other end of the horse, then maybe there's isn't much pointing in driving a general panic.)

    But the system is totally messed up and we cant have an overnight change .Even if they initiate something now by the time it gets actually implemented it shuld be more than 1 year.If nothing works out within atleast 1.5 years to 2 years this should be definitely considered.

    This thread is getting very interesting with all the logical calculations and predictions, thanks OP.

    One aspect that was missed in the discussions so far is, during Aug-Sep'08 many folks with 2005/06 PD's got their GC, USCIS picked these cases on random and not sure how many with 2005/06 PD's were approved but it a sizeable number, so this reduces the pending numbers for 2005/06 PD cases as well. I am predicting by Sep'10 we should see all of 2006 PD's cleared up.

    you are right in Aug 2008 so many people wth PD of 2005 & 2006 got approved. I would have been a lucky one but unfortunately my Birth Certificate turned out to be the culprit and ended with with an RFE. By the time I answered the RFE visa # were exhausted and I was left behind.

    As per Macaca's logic, pre Oct 2005 PDs will take up all the numbers available for EB2 Indai for 2007, in June and July.

    If that is the case why was the Bulletin for july not set to Oct or Nov 2005 and instead made current. Surely USCIS does not want to deal with all the extra workload if it does not have to.

    DOS/USCIS know the truth, but going by the Ombudsman's report, they want to use up visa numbers as fast as they can. So if they have 30K applications sitting, just waiting for visa numbers, now with everything set to C, they can blindly start approving without even seeing what the date on those apps is.
    Also, with EB3-ROW being 'C' they dont even need to worry about per-country limits. Just pick up the next almost-approved file, assign visa number, mail out. repeat.

    One important point from the document: If employer can not directly control/supervise his employee's work and then H1B new petition/extension may not be approved.
