I'm thinking about pursuing maser degree of Biostatistics.
I heard the job market demand is high and
most jobs require master degree at least.
As a research assistance, biostatistician, research analyst..
Could I apply as EB2 ?

Is there and on going class action lawsuit? and if there is where can I get info to join. I filed for a k3 visa a year and 110 days ago. Till this day USCIS still wont approve my applications because they say that we are stuck in bacgkroud checks. I dont understand how people that field way after me already have their spouse here while I have been waiting for over a year and we still dont have the NOA2. What can I do, where can I joint o get help. Is there a class action going on for this?
Unfortunately there is no class action for your case. It's hard to file a class action for mandamus suit as the circumstances of each case are different (i.e. different waiting time). But you definitely can file an action for yourself and defend yourself from the injustice. Check this court order, it may be helpful

I saw the same status message yesterday. But it was delivered today morning at 5:40 am!, Weird!!
I dont know if other Folks have seen the same thing. My renewal EAD application has reached Texas (TSC) today June 5th around noon by USPS Express Mail but the status says

You can try re-sending the pkt with a label in bright color with text "Not to be opened by mailroom" so the package can be opened by an IO..Include a cover letter with the details/proof of your earlier application....You can give this a shot but its solely upto the IO to decide whether he accepts your application or not..In the meantime, I would also start a fresh LC process....Sorry about your situation, but there is nothing you can do.....One more case of lawyer screw up......

That I agree, I should say it was some what an exaggeration when I said I could predict NASDAQ ...
But son't you guys think that this uncertainty also adds to the excitement of life here for us? Don't get me wrong ... just sharing a perspective here! Even I want my GC as desperately as any of us :)

I write this letter to verify that Mr. XXXX XXXXX worked at YYYY YYYYY from Aug 1998 until December 2004. During this period he worked 40 Hours per week.
I think, individual can not possibly give "worked in company from... to..." and "number of hours". Only company representative can can sign that. The ex-coworker can certify only that "YYYY YYYYY worked with me from... to ...".
Mr. XXXX XXXXX rendered these services with the highest degree of responsibility and professionalism.
Ex-coworker can say that "While working with me Mr. XXXX XXXXX has shown responsibility and professionalism".
As I mentioned earlier in this thread, the scope of ex-coworker giving experience certificate is limited to "working together". For example, some one behaving good with you might not be good with someone else. In company records, he might not have good records due to that.
My lawyer strongly asked me that ex-coworker must write only on the basis of his own experience. He must not start representing company and start mentioning things like joining date (unless the person hired you), salary, etc.

What is bothering me is that they told us the Wrong Information PLUS lawyer was just asking for filling fees(which is 745) during the time of signature but now Company is charging even for legal fees.
I believe they want to earn extra money from us. What should we do now about this wrong info?

The US company who offers you the job, are the ones that apply for a H visa not you. They have to prove that you are qualified for the job they are offering you and that you are not taking a job away from an American, that your qualifications are equal or more than American qualifications, they have to pay you within a set pay scale for that job in that location.

So If we find a job where they are willing to do H1 then will it be like getting the H1 for first time? ...like part of the yearly quota where H1 starts from October or will it be like just file for H1 and start working with the receipt in hand.
Also is there is difference between new H1 b and transferring H1B , from the perspective of the company(that's willing to do H1) . I mean , will the companies hesitate if they have to file for new H1 as against when they have to file for transfer ?

Your next H1-B will be considered a new H1-B and not a transfer.
You will be able to use remaining H1-B time. There is no difference whether the employer revokes or not revoke your H1 as you are no longer on H1-B.

pls quote the exact sentences of your rejection letter here. we need to know a reason for your rejection.
ask your lawyer or find out exactly what they screwed up.
also let us know
- is your lawyer a company lawyer or your lawyer
- what is the status of your company--- big/small/ many h1b/ what about others in your company on LC applications..etc
- did the comapny do ads? do you have the material or copy of everything that was sent?
- is your company making profits. how many employees?
- eb2 or eb3
- has anyone been rejected before in your company?
- how much time do you have on h1b

My mother-in-law is coming to US on 2nd Dec on a one-way ticket, she will be going back around March 09 i.e. in almost 4 months.
As we dont know abt the dates as such of return so we have booked a one-way ticket from India to US.
Will there be any problem due to that at port of entry?
Do she also need to carry travel insurance along with her?
