    I could open Ohio college fund for my kid. They requested my child's social security number. ITIN does not work. I explained the situation that I cannot obtain one until GC. The customer service rep said it is okay to open without it but provide the SSN once acquired.

    I think the biggest problem with the restriction is when trying to get a job. Many employers openly say they will not sponsor H-1B or green card. To be more precise, there are few companies who would do it.

    Are you sure they wont let you open an account even if the kid is american citizen by birth?

    i really dont care, i still think interfilers and substituters should get what they derserve. every single bit of it. may they really, truly, go to hell, and stay there indefinitely.

    and NO, dont preach to me about trying to "fix" the system. the agenda here is mostly EB3, and mostly Indian, at best. the multitudes of diploma holders get pissed when i call them out for what they are...........why are THEY so sensitive and ashamed???

    i have a RIGHT to be in the proper EB queue, which i EARNED, and did not employ cheap desi-employer tricks and other games to get into........if that does not answer your doubts my friend, then as i said earlier, ban me..........i dont really care either way.

    i dont advertise what i have done or can do for IV. somehow, that is a little demeaning. sort of like going to a temple and offering some money and then coming out and proclaiming to one and all how generous a give you are....

    As far as dates for India goes, its out. Bulletin on USCIS website will have details for all other countries as well which doesn't matter much to us...

    Yes, they can do a lot more than 25 k in 2 months.
    EB2 folks, please get prepared for RFEs - a few possibilities.
    1. Medicals, outdated physicals, PPD positive etc.
    2. Passport expired since applying for I-485 last summer.
    3. Father's or Mother's name misspelled.
    4. DOB discrepancies.
    5. Translations of documents
    6. Find those old pay-stubs, bank records, W2s, I-20s
    7. Google yourself and your spouse.

    Here you go - conversion should not impact this as the number of LC approvals remains the same:

    Here are all the LC approvals for India in the last seven years.

    Lets assume about 25% of pre-PERM LCs are India based on post-PERM data. Thus for fiscal 2004 (Oct 2003 thru Sep 2004) the total LC number is 43,852. Assume 25% of that to be India based on PERM data. That gives about 11,000 India LCs in 2004 alone (All EB categories combined). If you assume an average of 2.5 dependents then the number of visas required for all India EB categories for 2004 is 27,500 (11,000*2.5). The regular quota for EB2 and EB3 combined is only about 9,800. That means 17,700 visas have to come from somewhere. I dont think those many visas are remaining for this year. Be prepared to see FIFO thrown under the bus and approvals with PDs that are all over the place. Please critique this analysis without piling on. Thoughts?

    There is a mistake in your numbers, thousands of cases applied for in 2005 were approved in 2006.
    If you look at the 2006 PERM Data Sheet, there are 7290 Approved, India cases with receipt dates in the year 2005.
    I'm assuming PD = PERM Receipt Date (correct me if i'm wrong)
    Similarly for 2006 in the 2007 tables.

    Therefore there are ~ 8700 - EB1, EB2, EB3 cases in 2005 and not 1350.

    E. EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY

    There have been questions raised regarding the way numbers have been provided to the China and India in the Employment Second preference categories beginning in April. Section 202(a)(5) of the Immigration and Nationality Act states that if total demand for visas in an Employment preference category is insufficient to use all available visa numbers in that category in a calendar quarter, then the unused numbers may be made available without regard to the annual per-country limit. (For example: If the second preference annual limit were 40,000, number use by �All Other Countries� were estimated to be only 25,000, and the China/India combined number use based on their per-country limits were 6,000, then there would be 9,000 numbers unused. Those 9,000 numbers could then be made available to China and India applicants without regard to their per-country limits.)

    Based on the informaiton available, it was been determined that the demand from �All Other Countries� for Second preference numbers, plus the amount of numbers available under China and India Second preference per-country limit, would be insufficient to utilize all available numbers under the annual limit for this category. Therefore, pursuant to Section 202(a)(5) of the Act, the unused numbers have been made available to China and India Second preference applicants. Since Section 203(e)(1) of the Act requires that such unused numbers be made available strictly in priority date order, the China and India applicants have been subject to the identical cut-off date. As there are more Employment Second preference applicants from India and the Indian applicants may have earlier priority dates, it is likely that Indian applicants will receive a larger portion of the available numbers than Chinese applicants.

    It should be noted that the Employment Second preference category is "Current" for all countries except China and India. If at any point it appears that demand from �All Other Countries� would utilize all available numbers, then an adjustment would be made to the China/India cut-off date. Therefore, providing the unused numbers to China and India in no way disadvantages applicants from any other country, and helps to insure that the worldwide annual limit can be reached.

    And, please, gimme a break. H1B = high skilled? ya right.............keep living in your dream world buddy.........good for you. Most H1Bs, according to PUBLISHED research, earn less than $50,000.

    Freaking diploma holders from India get an H1B easily...........you think the monkeys who work for the outsourcing firms in India are "highly-skilled" ??

    Dude, IT and software are low skill jobs..........wake up and smell the coffee. Your saying "highly skilled" and holding up a placard won't change that reality. No one wants any more low skilled EB3 types in this country anymore. They are found dime a dozen.

    IEEE-USA has recently changed their site. Earlier their title was H1B visa. Now the title is Immigration Reform.

    IEEE has a huge number of Indian, Chinese and Korean members. I would not be surprsied if > 50% members are immigrants.

    I have not heard that Programmer's Guild/Lou Dobbs supports IEEE-USA or vice-versa. Please let me know if you have a reference.

    Will she get paid starting Feb 1st? If no, why not. Please explain.

    She wont get paid starting Feb 1 but there is an option to get paid from Feb 1 - April 20 as she accumulated some $ when she was working and after April 20 she will be on maternity leave which will be unpaid.

    To answer why she will not get paid - she does not have a project right now and dont even plan to find one....(bad economy and no one will be willing to employ a preg. female who will need 6-8 week vacation after 2 month of hire)

    Will she on unpaid leave? Yes.

    Will she still be Full Time Employee? For the employer C which is a desi consulting firm she is a FTE but you know how the consulting business works........as long as you are on project you get your salary and the day you are not on the project you dont get a dime.

    On H1 Status, one must be working full time and should be paid salary even if s/he is on benching. Three month maternity leave should be ok, but 6 months of unpaid leave will be very difficult to explain.

    You should seriously consider changing status to H4, if that is an option.

    In Nov, she can re-enter on H1 visa to come back to H1 status.

    Point V and part 2 covers only eb1 thru eb4 only.

    Employment based visa numbers 140,000 is for eb1 thru eb5.

    As mentioned in my previous post in this thread, for FY2008 family based numbers are totally used, so there were no unused numbers for employment based FY2009 numbers.

    I am in for this. Is this something that can be a planned effort rather than a impulsive exercise?

    I think we should -
    1) Wait till this session of the Congress gets over.
    2) Form a work group that will chalk out the plan (of efforts).
    3) Execute the planned efforts.

    Efforts could include things like -
    1) Discussing the proposal with supporting Senators like Zoe Lofgren.
    2) Making conscious efforts to publicize our woes and genuine issues / conditions.
    3) Quantify the benefits of our presence - in evidence of a quantified evidence, idiots like Loo Dog, etc. can't refute that much.
    4) Talk to organizations like Lazaras (or some org.) form a more cosmopolitan group including Chinese and others as well.
    5) Letter campaign in mass to all Congressmen's offices telling them the sad story about waiting for 8-10 years.
    6) Any other efforts that CORE comes up with.

    Planned & focused efforts always yield desired results... I believe so.

    xyzgc. I agree with your risk assessment personally. However, the risk aversion threshold is an individual thing. Some people never drive on the fast lane, and some people jump off a cliff tied to a rope. So, IMHO, it's unfair to say something is stupid and foolish. It's just that somebody might just like to live a little more dangerously than you are (and reap more benefits if things go well).

    IMHO, what is stupid is doing something and not knowing/understanding the risk. :rolleyes:
