On 7/2/07 the door was slammed shut for many skilled legal immigrants without notice while only 2 weeks earlier these same legal immigrants had been notified that the final stage of their immigration i.e.: green card processing, could begin. This occurred not because these legal immigrants had not followed the rules but rather due to scandalous government actions. These actions have caused outrage & devastation amongst skilled legal immigrants and immigration attorneys alike who question the government�s credibility and the government�s disregard for precedent and the law. The results may be costly litigation and a class action lawsuit by the governing body, the American Immigration Lawyers Association against the government.
Much focus has been placed on illegal immigrants in this country. Yet, the broken immigration system holds ominous consequences for skilled legal immigrants which the US needs to remain competitive and at the forefront of technological and medical development. The obsolete immigration laws do not address this need and government missteps further contribute to the persecution of law abiding skilled legal immigrants who wait patiently in line and live with severe restrictions for many years while their immigration cases are processed.

I posted this message on another thread and got slammed - :confused:. All the discussions here are just speculations.. no one really has access to real numbers.. so take it easy this time :p
As we do not have any real numbers my predictions are based on EB2 numbers from (assuming the data to be a true random sample)
Here are number of EB2-I I485 pending cases by year
2007-100
2006-150
2005-125
2004-200
2003-50 (250 have been approved)
USCIS has approved about 450 EB2-I cases last year. A conservative estimate of approval rate going forward would be 30 cases per month. Based on this the movement..
2003 cases will be approved by Sep '08
2004 cases by Apr '09
2005 cases by Sep '09
2006 cases by Dec '09

My Q' was, if it becomes effective on 27th April, will USCIS reject all pending cases ?It depends on wording in final memo. Nobody knows what is there. The only text we know is that was published for comments. There could be changes after comments period. Without changes all pending sub cases (without approved I-140) will be denied.

If you think Memo is illegal why can't you file a lawsuit. That should be right way. But I did not see any suggestion from any lawyer. But when when July 2007 issue cropped most lawyers rushed to file lawsuit. Now no one even suggesting lawsuit except some members in IV. Either most are not interested or they think no legal basis to contest memo
I have been observing JoeF's posts from different threads. I can say for sure he doesn't know what he is talking about. He is just another sadistic person like snram4 on this forum.

Such people give a bad name to high skilled immigrants. They give fodder to anti immigrants to talk against H1Bs and greencard applicants by talking about abuses and exploitation.
IV is against any kind of breaking of the law and condemn such people. I'm sure DOL is watching Sulekha website since this is the place where such ads have been posted and reported.

People's idea about patriotism is different.Like some folks
Spend hours drinking in the wake of Mumbai attacks
Say they would go back to India to fight if rumors about the war between India and Pak post Mumbai attacks is true.
So patriotic so much so that when IV avtar feature is introduced they even upload a soldier's picture albeit for few min.
When it comes to PM of India they would want western breed like Nostradamus kind Simon,Sweet voiced Susan or half Indian Saino.
Can we call them unpatriotic ?NO!! .That's their patriotism what if it is a bit different in style.(No I didn't spend time digging into anyon'es old posts.Just when someon'esr patriotism seemes interestingly interesting we get to remember some things)
Then moving to IQ:
Some people have such high IQ that they go into the mind of the anonymous members on a forum and find out that these members think they are political strategists ,just that they did a bad job at reading the mind.(None of the members that posted in this thread said they think they are political strategists if anything they repeatedly said that they are sharing what they know.But you know this IQ thing when it's on High it does strange things.)
Facts in politics (in general) and Indian politics in specific are intricately bonded and it's not much possible to state a new fact without stating already mentioned fact(as proof)
For major part of 60 years in Indian political scenario we are repeating the same family to hold top most position,we are repeating same mistakes, what's mere repetition of few facts on a forum.

It wont be an issue since you already gor your GC or I-485 filed. I failed to understand still what you are doing here.
If one filed I-485, isn't employee-employer relationship comes under a questionmark? what if that company is closed ? And if this memo is implemented, most of the GC filing IT Inc. will be shut down sooner and hence will be a big mess..they are the ones who are supporting for their GC.

I am legal resident alien working in USA on H1B Visa. I am waiting in queue for my Green Card.
The way process works is my employer applies for Labor certification. Once it is approved by Department of Labor I file for I-140 and I-485 which is last step to adjustment of status and gives me Green Card. I rely on Department of State (DOS) for visa dates to file I-485. When I move to this stage, I bear expenses close to $3000 for completing application process itself.
Recently on 13 June 2007, DOS issued Visa Bulletin (VB) stating that all visa dates are current for (almost) all employment based immigrant categories. Since this is the only information me and my employer rely to start application for I-485, we started the process. We collected all documents, took medical examinations, paid attorney fees and got the document ready to be sent over, as was expected by DOS and USCIS as part of the process. I am not going into details of the hard works, sleepless nights, leaves from work and expenses as part of this effort.
When my employer was about to send this package to USCIS, DOS came out with revised Visa Bulletin. In this they revised the earlier Visa date availability. USCIS followed the suit and decided to reject all applications, which they by their 13 June 2007 proclamations were ready to accept. This might be trivial thing for DOS and USCIS but not for me and thousands like me. This action of USCIS has no precedence. That is against its (USCIS) regular processes and guidelines and smacks of disrespect for its own procedures, guidelines and we immigrants, who rely on it.
This is not just emotional trauma for me and my fellow immigrants but a major financial loss worth $3000/per person applying.
In the end, my question to US Congressmen, USCIS and DOS is who is looking at impact to us? Were we wrong when we followed DOS Visa Bulletin on 13 June 2007? If not, why we should bear the financial and other losses? We are legal, law abiding residents. Does being good residents make our trials and tribulations meaningless and irrelevant for laws and departments of USA? To me it sounds unfair and unjust. Please let me know your thoughts and what you can do to alleviate my trust on American Immigration System and Departments devoted for that.
