If you are chosen and pass the first screening, when they ask for documents you are also sending application fee that is around 500$. And GC is still not guranteed if the chosen applicant cannot persuade IO he will settle successfully. You need to show the ties, someone to help you with the job, show the moneys for the first few months, etc etc..
I personally know several people who were refused based on their family size and that they would be below poverty line if they immigrate into US.
Go figure!

Whom did you talk to? Was it is IO?
I did receive a letter from USCIS for my SR stating that they will be sending me a FP notice soon last week. I am still to receive it though. But while i opened the SR for me and my wife it only mentioned my name on the notice.
Perhaps we have to open 2 seperate SR's for me and my wife?
Does anyone know how long it takes to receive the FP notice after such a letter which acknowleges your SR request?
Nov 13th. Recd FP Notice Nov 19. Appt next week. Notice created date is Nov 13.
Got a real nice lady on the phone who mentioned that FP should be coming soon and may have been delayed due to TSC-CSC-NSC transfer, which made the "actual" receipt date at NSC Oct 15 instead of July. She said she would put a request in the system to get FP scheduled soon. Not sure if the call had anything to do with it or not, but looks like notice got created same day.

Posted the letter to whitehouse address with the following contents:
"I am writing to inform you of how the country based quotas imposed on Employment Based green cards are unfair and illogical. I came to the US with the belief that this country is a meritocracy where you are judged based on your abilities and qualities. These country based quotas judge people based on their place of birth. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in a fraction of that time. Lack of permanent residency has made me hesitant to buy a house or to do any long term investments in US and I want to get out of this limbo at the earliest.
My requests to you are:
1. Eliminate country level quota on Green Cards (to reduce the backlog of permanent resident applicants)
2. Recapture unused permanent visa numbers from the past (to allow USCIS to issue permanent visas to eligible applicants whose applications have been processed and pre-adjudicated)
3. Issue 5-year EAD cards (to reduce workload on USCIS of administrative renewals)

There is no freedom and especially education in India. in US even if you are a 60 year old you can join a university but in India things are different
What do you mean? My father was an engineer and he started his Bachelor of law at age 58 in 1996 in India, after retirement. regular college, which only 10% pass out off.
Again never compare Canada with India, India is Unique and I am not putting my Motherland on Trash, You are in a way doing that, by comparing it with Canada and USA.
I'm only comparing the economy and education not the culture.
STOP religious Conversion and propoganda all over the world all the countries will live happily.

We have applied for our AP renewal on 05/09 at NSC. I have noticed online status change to our I131s today with the following message. Is this a RFE? if so, what could be the RFE for AP? Your help and input appreciated.

Yes might be but Labor cert is not being part of list of docx that need to be attached even if ur 140 is pending as if you would have included I-140 receipt notice but in your case it seems better u do it rather feel sorry . But refiling in many normal cases wont help much unless if there is an issue in it.
I would not re-submit only for EVL, but it is important you review your entire AOS application set that went out to USCIS.
I reviewed the photocopies of our AOS applications and found a few omissions e.g. not including
1. EVL
2. pending I-140 receipt notice
3. Labor cert approval which would clearly show the priority date-- instead they put a wrong priority date in the covering letter.
I decided it is a higher risk to rely on such a messed up application!
Hence, I am working to re-submit our AOS. I asked that I review the entire application in advance this time around:) Thanks IV... I have come a long way because of YOU!
BTW a small issue I found on my family's AOS applications:
For my dependants... in Part (2) Application Type, I think we should check (b) my spouse or parent applied for....
it is currently (a) an immigrant petition giving me....
It was also (a) in their first set of AOS applications
Am I right in saying the checkbox to be selected is (b) not (a)?

With due respect, please refrain from posting pessimistic rants originating from unofficial sources. This may be true, but common sense should tell everyone to wait for such news to come from official sources.
These are things beyond our control. Best not to get anyone's panties into a bunch over such news. If the GC is not possible, that is still OK. Move back to the country of origin and life will go on - thoug not as planned.
The last thing we should be doing is whine about our troubles.

Urgency of getting a receipt is that once you get the receipt, it means that USCIS has 'accepted' your application and it will not be rejected for lack of initial evidence.

The anchor started off the interview by making a reference to "hi tech workers" and that some of these folks were in the British terror plot !! "Why are you filing the lawsuit when your client can apply for the GC in Oct?" !!Anyway, the attorney was quite articulate in explaining the issue. Guess who followed the attorney ... Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

Also, if you google there was precedent with some guy from India. Who had similar agreement and left the company. The company sued him and lost, appealed and lost. The guy sued back and won, the company paid $200,000+ something expenses. The case was long ago, I don't remember the link.

She may not get a visitor's visa. Visitor's visa requires non-immigration intent, just like F-1. In your case, there is a very clear intent to immigrate, which may disqualify her from getting a visitor's visa.
OK guys, here is what I think. Being in US on a visitor visa, and then applying for an I-485 does seem like a violation of visa terms, but the other way round seem to be fine. I mean she can apply for an I-485 first in India, and then apply for a visitor visa later while her I-485 application is pending. While applying for a visitor visa she just has to honestly tell the consulate officer that her I-485 is pending and there should be no problems.
If this is not so, then it means that all those who have filed I-485 in their home countries through consular processing route are in effect barred from entering US till some decision is taken on their application. This sounds bizarre. Does not make sense. What do you say?

My Job duties on labor says
"Design, develop and test software using Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP"
The title in labor is "Software Engineer"
Now the new job offer has title as "Lead Developer"
and duties are
"The lead developer will be responsible for leading a team to creating components within Java, utilizing standard Integrated Development Environments (IDEs), writing unit test cases and supporting the Testing and Quality Assurance phases of the software development lifecycle."
Can somebody comment on this in context of same / similar job?
Wow, any company would love to hire someone that is capable of Designing, developing and testing software in Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP...That's very very versatile....I work on SAP, just SAP, and I already feel like its a ocean. Maybe that's why I'm in EB3.
