    It is not that i have full basket of apples now... my previous 2-employers promised me to start labor...but they did not do it..even i sent my docs 2-times to the previous employer ..but they gave lie assurances & very dumb...so i have lost my 2.5 years just waiting on their promises...& nothing got.

    Finally, I made up my mind ...either to get it on fast track OR leave this option... forever.

    I don't see anything wrong in it...as the previous person already left that labor unused... & employer needs those skills..which he found in me.
    I would advise you to not worry about the naysayers on this thread!!

    to each his own and as long as the lawyer signs off on it and you are convinced that the company is genuine, go for it.

    for pete:
    it is easy for you to pontificate. all things (salary + benefits + job satisfaction) being equal, if you got an offer from another hospital/university with an older LC that would allow you to file for your 485 on Monday, WOULD you not take it?

    There are only 2 possibilities - you get RN or you don't get RN

    1) You get RN. Congrats you got your - rather overpriced - lottery ticket. Winning the lottery is still far off. Considering 300,000-500,000 apps and 140,000 numbers, chances of winning it soon is as slim as the chance of getting struck by lightning. You might as well laminate it and hang it on the wall.

    This will be the only piece of notice we will be seeing for many more years. Unless, of course enough of us get over our collective OCD (Obsessive Compulsive Disorder) over RNs and concentrate of real-life action.

    Moral of the story : RN is a lottery ticket. Keep it safe. But, don't mistake it to be the prize.

    PARTICIPATE.

    2) You don't get RN/or Rejected. My sympathies. Your ONLY CHANCE to get RN in the foreseeable future is to end backlogs/retrogression. That wouldn't be possible if YOU didn't participate in the rally. Please don't participate in the rally if you choose to wait 5-7 years, for your next chance to apply.

    Don't count on another July 2. It was a flash in the pan caused due to one-upmanship b/n DOS and USCIS. I'm sure both have learnt their lessons well to stage a repeat.

    Moral of the Story: Your only chance is if IV succeeds [ because there's no one else interested in you - Highly Skilled or otherwise]

    You SHOULD care. Because you didn't file 485 just for the heck of it. You filed it to get a GC, and to get a GC - ASAP.

    I hate you break your day dreams, chum, but that's not likely to happen for a decade more.

    b) EARNING OPPORTUNITIES lost as a result
    c) your FAMILY that's the victim of your procrastination

    You know whom to blame when you

    1) Finally look at a posh home , few years down the line, one that you cannot afford

    2) Your kid cannot pay attend a good college and get a good degree, because you cannot afford it.

    3) many more regrets....

    Dang! If only you had spent 100-300 bucks in the September 18th of 2007 and walked two miles with the others. If you you were not so penny-wise and pound-foolish. Sadly, regrets don't change the reality.

    I'm not saying Sep 18th will change the present. It may or it may not. But at least we tried. Even if, God forbid, we fail there's the satisfaction of having tried.

    To quote a rather famous Hindi/Urdu saying - Only those that ride the horse (warriors) fall. And not those that grovel on their knees (mental slaves). It is for each of us to decide whether we wish to ride, or we wish to grovel. That's the decision each one of has to make for his/her self. No one else can do it for you.

    If you choose to grovel, I give you a friendly advice. You're groveling in the wrong place. If only you were groveling in Saudi Arabia - where goveling would be much appreciated, may be the sheikh might throw in a extra dinar or two - you'd be earning twice as more ( typically 1 Saudi Dinar = 2 dollars).

    I think there are people who have a labor pending from July 4th 1776 , so they might take the date back to July 4th 1776 when the US was formed and when the USCIS was established . However they will then not allow people living in the west coast and the then Confederate states to apply , only people living in the Union states will be eligible to apply .

    misdemeanor charge and green card

    I may be charged with Misdemenor Class A for Domestic Battery around 15th of Nov/1st week of december(Court Dates).
    Am I screwed for green card? I applied for 485 in July, got EAD.

    Will there be a Deportation process involved? I am prepared for the Worst hpoing for the Best...

    This is my first offense.. I have not had any offence at all...

    Will being on Probation cause a issue. I spoke to my Immigration lawyer.. he said I will be called for a Interview...
    He asked me to tell the Criminal Lawyer to try to get supervision. but he said not to plead guilty...

    When I relayed the same to my Crim lawyer,, he said it will be difficult to get Supervision if we plead not guilty...

    So does it mean Misdemeanor does not qualify for Deportation?

    I am cofused whether to plead guilty or not...



    Were you witness to what happened in his home on that day?? If not, don't be judgemental....leave that to him and his wife and to family court. IV is not for "every good cause"...we are having very difficult time ourself...

    Looks like you already received GC and you have great & lot of time to get into other issue.

    Applied for EAD and AP together (e-file at TSC center) in the last week of Nov 2010 and got the EAD card yesterday in mail. The validity period is for 2 yrs. The online status for EAD updated accordingly. However there is no status update for AP.

    How many days before expiry can one apply for

    1. EAD extension.
    2. AP extension.
    3. Since EAD extension is possible only because of 485 pending, is there a chance of risk, if employer withdraws 485 for some reason.

    Well, you are missing the most important point - Illegal immigrant's probably don't care about the future of the country's educational direction. Family based immigrants don't care either. However WE are EB immigrants and we value education and that is exactly what we demonstrate by doing this. We should not be looking to fund hundreds of thousands of student's college education - heck even the mighty US government cannot do that. We are not a political organization. The way this will go out in the media is - these guys could have used the money to lobby with senators or other congressmen, instead, they choose to use it for a good cause. This is highly symbolic. And the key here is to involve the first lady. The moment you involve the first lady, it become apolitical.

    Oh, and btw, we are not buying our way into a GC. Nowhere did I mention that. We, EB immigrants value education and hence want to donate for an educational charity/cause. We don't expect a GC by doing this - this is highly symbolic; however if the Obama administration takes up CIR this year and we start this campaign and this happens to go to the first lady and gain media attention at the right time, perhaps the administration would include legal immigration in the CIR which would have otherwise not been included.

    Timing is critical to this. If we gain media attention a few weeks before CIR comes up for debate, we might have Legal, EB Immigration included into it. And CIR this year is our only chance and hope and if EB immigration is not considered parts of CIR, then we might as well kiss our GCs good bye.
    Hey - I am just pointing out how it can be played in the media to make the eb community look really bad. Do we seriously think the media and common man will believe that we are suddenly doing this out of the goodness of our hearts and a genuine concern for educational system in us - most people will see it as a well timed publicity stunt to influence decision making in our favor.

    As DOS has posted the NVC backlog numbers as on November 1, 2009, if the core team look at it and update the analysis. This data is not categorized via month but still may be helpful in prediction.

    In my view CP Data published doesn't help much here are the reasons. They need to publish the data in the same lines of CIS.

    1. For EB2 3K visas doesn't change the dynamics.

    2. For EB3 adding 20K visas will slow things more. But beyond that we can't say anything else.

    3. ROW EB3 will be slow and Philippines will be dead slow.

    The biggest thing that CIS/State needs to understand is that for EB2, they are going to pass 2007 Fiasco cutoff in the spillover and may waste the numbers.

    We need to let them start a long term planning and make sure they don't waste visas. It is unfortunate that State thinks CIS can process all the AOS applications in a calendar quarter in most cases and in a month in some cases during end of year scenario. State needs to include DOL statistics and CIS processing bottlenecks to advance the dates. It is unfortunate that none of these agencies can sort their applications on date correctly.

    Arizona is at ground zero of our broken immigration system.
    People are frustrated and want action.

    Action feels good. We see a problem and we want to fix it. We write and pass laws that seem like they'll do the trick: punish people who break our laws; deport people who don't belong here. Except sometimes what looks good and feels good, isn't always good. We end up with reactionary laws that waste precious resources and do nothing to address the source of the problem.

    If signed into law, the bill would shift the burden of enforcing immigration laws onto the shoulders of cash-strapped local police departments who cannot afford unfunded enforcement-only mandates. It would exacerbate community tensions and undermine community policing and public safety by making immigrants afraid to cooperate in police investigations.

    Most tragic of all, the state would be forced to waste millions to defend itself against the civil rights lawsuits that will rightfully follow. Similar ill-advised anti-immigrant laws in New Hampshire, Pennsylvania and Texas have been struck down by the courts at great expense to taxpayers. With a record budget deficit, does Arizona really need to spend another dime on enforcement strategies that will do nothing to solve our immigration crisis?

    How Much Will Arizona's Immigration Bill (SB1070) Cost?

    April 21, 2010
    Washington, D.C.- Frustrated by Congress' failure to pass comprehensive immigration reform, states across the country continue considering legislation that relies heavily on punitive, enforcement-only measures which not only fail to end unauthorized immigration but also have the potential to dig their state's finances deeper into a hole. The latest example of this kind of policy nose dive is in Arizona. A recent bill, "Support Our Law Enforcement and Safe Neighborhoods Act" (SB 1070), was passed by the Arizona State legislature and awaits the signature of Arizona Governor Jan Brewer. As the Governor ponders whether or not to put her signature on SB 1070, she should consider the potential economic impact of the bill, which would require police to check a person's immigration status if they suspect that person is in the United States illegally. This bill, if it becomes law, will likely affect not only unauthorized immigrants, but all immigrants and Latinos in general. Given the vital role that immigrants and Latinos play in Arizona's economy, and considering Arizona's current budget deficit of $3 billion dollars, enacting SB 1070 could be a perilous move.

    At a purely administrative level, Gov. Brewer should take into consideration the potential costs of implementation and defending the state against lawsuits. As the National Employment Law Project (NELP) points out in the case of other states that have passed harsh local immigration laws, Arizona would probably face a costly slew of lawsuits on behalf of legal immigrants and native-born Latinos who feel they have been unjustly targeted. This is in addition to the cost of implementation. For instance, NELP observes that "in Riverside, New Jersey, the town of 8,000 had already spent $82,000 in legal fees defending its ordinance" by the time it was rescinded in September, 2007. Also in 2007, the county supervisors in Prince William County, Maryland were unwilling to move forward with the police enforcement portion of an immigration law after they found that the price tag would be a minimum of $14 million for five years.

    More broadly, Gov. Brewer should keep in mind that, if significant numbers of immigrants and Latinos are actually persuaded to leave the state because of this new law, they will take their tax dollars, businesses, and purchasing power with them. The University of Arizona's Udall Center for Studies in Public Policy estimates that the total economic output attributable to Arizona's immigrant workers was $44 billion in 2004, which sustained roughly 400,000 full-time jobs. Furthermore, over 35,000 businesses in Arizona are Latino-owned and had sales and receipts of $4.3 billion and employed 39,363 people in 2002 - the last year for which data is available. The Perryman Group also estimates that if all unauthorized immigrants were removed from Arizona, the state would lose $26.4 billion in economic activity, $11.7 billion in gross state product, and approximately 140,324 jobs, even accounting for adequate market adjustment time. Putting economic contributions of this magnitude at risk during a time of recession would not serve Arizona well.

    With Arizona facing a budget deficit of more than $3 billion, Gov. Brewer might want to think twice about measures such as SB 1070 that would further imperil the state's economic future and try instead to find ways in which she can bring additional tax revenue to her state while pursuing smart enforcement that will actually protect Arizonans.
